Q. What is the definition of Disability under the Social Security Act?
A. 20 CFR 404.1505 - The inability to do any substantial gainful activity by reason of a medically determinable physical or mental impairment which can be expected to result in death or which has lasted or can be expected to last for a continuous period of not less than 12 months.
Q. What is a disabling impairment?
A. 20 CFR 404.1511 - An impairment (or combination of impairments) which, of itself, is so severe that it meets or equals a set of criteria in the Listing of Impairments, or which, when considered with your age, education and work experience would result in a finding that you are disabled under 404.1594.
Q. How do I get Social Security Disability?
A. Take the following steps:
- File an application by calling 1-800-772-1213 and completing the forms which include a 15 year work history and a medical history. The application process can take more than one phone call to complete and sometimes the Administration will have someone telephone you at a later date to complete the claim.
- You must have insured status (worked 20/40 quarters).
- You must have medical evidence to support your claim. Contact your physicians and obtain treatment records and/or narrative reports that document the severity of your condition and your inability to work.
- Respond promptly to any requests from the disability office or the Social Security office.
- When completing forms, answer the questions completely. Utilize the questionnaires that you receive to repeat your limitations and restrictions.
- If you are asked to see a social security doctor, give copies of the reports from your physicians to the examining physician.
- If you are denied, seek help immediately.
Q. What is Supplemental Security Income (SSI)?
A. A federally funded program for persons with resources under the federal poverty limit who do not have insured status. The definition of disability is the same as it is for Social Security.
